Terms and Conditions for personal use

Introductory Provisions
These business terms and conditions of business natural person Veronika Tarantíková (IČ: 71487111), registered in the trade register kept at the Municipality of Kladno (hereinafter referred to as the "photographer") are regulated in accordance with the provisions of § 1751 paragraph 1 of Act No. 89/2012 Coll., civil code (hereinafter referred to as the "Civil Code") mutual rights and obligations of the contracting parties arising in connection with or on the basis of a contract or agreement on the provision of photographic services (hereinafter referred to as the "contract") concluded between the photographer and the client (hereinafter also referred to as the "client").

Provisions deviating from the terms and conditions can be negotiated in the contract. Deviating provisions in the contract take precedence over the provisions of these terms and conditions.

The terms and conditions are an integral part of the contract concluded between the photographer and the client. The client is sufficiently informed of these terms and conditions before placing the order and has the opportunity to become familiar with them. By concluding the contract, the client further agrees that these conditions become an integral part of the concluded contract.

All contractual relations between the photographer and the client are governed by the legal system of the Czech Republic. If the contracting party is a consumer, relations not regulated by business conditions are governed by the Civil Code and Act No. 634/1992 Coll., on consumer protection. If the contracting party is an entrepreneur, relations not regulated by business conditions are governed by the provisions of the Civil Code applicable to entrepreneurs.​

 

Ordering photographic services

  1. The client can order using the registration form at psifotografka.cz, email, phone number or on social networks.

  2. The photographer confirms receipt of the client's order and confirms the date, time and location of the photo shoot. With this confirmation, a contract is concluded between the photographer and the client.

  3. The photographer requires an advance payment of a specified amount in order for the order to become valid. The deposit serves as a guarantee of the client's commitment to the ordered services and secures the reservation of the photographer for the given date and time.

  4. The client is obliged to provide a confirmation of the payment of the deposit to the photographer Payment should be made according to the photographer's instructions and the confirmation should contain information about the amount, date and method of payment.

  5. The client has the option to request a change in the date, time or location of the photo shoot no later than 48 hours in advance. All changes must be agreed between the client and the photographer in writing or verbally. If the order is canceled after 48 hours in advance, the deposit is lost.

  6. The client is obliged to provide timely and accurate information to the photographer regarding the number of people, dogs, special requirements or other details related to the ordered services.

  7. The photographer is entitled to cancel or postpone the shooting date for important reasons (illness, accident, etc.). The client will be informed of this fact in time by phone or via message (email, message on Facebook, Instagram or SMS). 

  8. The Client (and other persons participating in the photo shoot) agrees to actively cooperate with the photographer during the photo shoot and to follow the photographer's directions and instructions in order to achieve the best possible results. Otherwise, the photographer is not responsible for the lack of quality shots. Likewise, this is not a reason to lower the price for photography.

Prices are given in Czech crowns (CZK) and include VAT.

Selection and processing of photos

  1. The photographer sends a gallery with unretouched previews from the photo shoot, from which he will select photos for final editing to the client no later than 1 week from the date of the photo shoot (unless otherwise agreed). The number of previews is not fixed, but it always allows for a sufficient selection in relation to the selected package.

  2. The client selects photos in the shortest possible time from the online gallery, where the photographer's already downloaded images (previews) are located. The photographer has the right to edit the selection of photos after consultation (for example, due to the quality of the selected image).

  3. The client is obliged to check the photos immediately upon collection. Complaints regarding the technical processing or obvious defects of the photos must be made immediately, but no later than within 7 days of receiving the photos. The photographer reserves the right to make corrections or rephotographs in the event of a justified claim.

  4. According to Copyright Act No. 121/2000 Coll. without the consent of the photographer as the author of the given work, it is not allowed to publish these previews anywhere or to edit them further (they are owned by the photographer and intended exclusively for selection for editing).

  5. The photographer does not provide unedited photos.

  6. Unless specifically requested by the client, the photographer has a free hand in terms of photo editing. The client is aware of the photographer's photographic style. Complaints in this regard are excluded. If the client requests changes during development, they must cover any additional costs that may arise.

  7. For photos, the following adjustments are made within the price: cropping, exposure balance, contrast, brightness, coloring, removal of small specks, sleep spots and saliva.

  8. Special requests for more demanding retouching (removal of wrinkles, straightening unruly hair, slimming, demanding skin retouching, etc.) are possible after agreement with the photographer for an additional fee of 200,- per photo - provided that the modification is feasible.

  9. Dissatisfaction with one's own appearance is not a reason for a complaint.

  10. The photos have an appropriate quality for the appropriate viewing distance. Viewing possible defects after enlarging/zooming in the photo is not a reason for a complaint.

  11. The client is obliged to pay the amount for the ordered photo package (reduced by the already paid deposit) to the photographer's bank account after selecting the photos for editing. The photographer reserves the right not to deliver the ordered and edited photos until payment has been made in full.

Delivery of photos

  1. Photos are delivered to the client no later than 1 week from the date of receipt of the full amount of payment (unless otherwise agreed). 

  2. If the client knows that he will need the photos sooner, he will order with this fact in mind in order to ensure a calm and stress-free processing of the order for both parties.

  3. Photographer sends photos via online storage. The photo download link is only valid for a limited number of days, after it expires the shipment cannot be downloaded and the photographer needs to upload it again.

  4. The client receives a full version of each photo with the photographer's logo.

  5. Processed photos are delivered in JPG format.

  6. The photographer is not responsible for the loss of photos already submitted. Upon receipt, the client downloads the photos to their devices and ideally backs them up. The photographer does not guarantee that he will have the photos available in his storage even several years after they were taken.

  7. The photographer ensures the archiving of photos taken during the shooting for a period of one month from the date they were taken. After this period, the photographer is not obliged to keep the photos and is not responsible for their preservation. Client is responsible for backup and long-term storage of photos after this period.

Copyright

  1. All photographs taken by the photographer are his property as the author of the work and are protected by copyright under the Copyright Act No. 121/2000 Coll. The client acknowledges that the photographs are protected by legal regulations concerning copyright and intellectual property. 

  2. The client is entitled to use the photographs solely for personal non-commercial purposes. This includes using the photographs for private purposes, sharing with family and friends, or on the client's personal social media. However, the client must not use the photographs in contests, for commercial promotion, or other commercial purposes without the explicit written consent of the photographer.

    If the Client requires exclusive rights to photographs, such requests should be made in writing in advance. Exclusivity can be provided for an additional fee or by individual agreement.

  3. The only exception to the above is the possibility for the client to use the photographs for the commercial promotion of their breeding station or specific breeding dog/bitch. The client has the option to use the photographs for commercial purposes under the condition that the original watermark placed on the photograph by the photographer remains intact. The client is obligated to respect the photographer's copyright even within the scope of commercial promotion.

  4. If the client is interested in exclusive rights to the photographs, such requests should be made in writing in advance. The exclusivity of use can be granted based on an individual agreement and for a possible additional fee, which will be specified in the contract.

  5. In case of copyright infringement by the photographer, including unauthorized use of photographs in contests, commercial promotion, or other unauthorized purposes, the photographer reserves the right to claim damages and take legal action according to applicable legal regulations.
